Terms and Conditions

Please read these Terms and Conditions (“T&C” “Terms”) carefully as they affect your rights and liabilities under the law. These Terms do not violate your statutory rights as outlined in the Consumer Rights Act 2015 ( https://www.legislation.gov.uk/ukpga/2015/15/contents/enacted ) By placing an order with Maya UK Holding Limited trading as Nifeislife.com - on the www.nifeislife.com website (“Website” “Nifeislife” “Our” “Us” “We”) you explicitly and implicitly agree to be bound by the T&C listed below which apply to any purchase made from Nifeislife. If you do not wish to be so bound, please do not use or access our Website and services.

1. AMENDMENT OF THE TERMS

1.1 These Terms are subject to change at our discretion from time to time. It is the consumer responsibility to read and agree with the up to date Terms. If you do not wish to accept the new T&C, you should discontinue the use of the Website and services. If, after amendments have been made to this Contract, the consumer continues to use Nifeislife.com, it indicates your agreement with the New T&C.

2. PURCHASE CONTRACT

2.1 All purchases made on this web site are governed by these T&C at any time although the T&C governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date and time when these Terms and Conditions were most recently updated.

3. ORDERING

3.1 We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.

3.2 The minimum spend is £30 (VAT & delivery fee exc) + delivery for all orders.

  • For the Selected London areas the delivery is free of charge when an order is above £70 (VAT & delivery fee exc)

  • For orders Outside the selected London areas a discount for a maximum of up to £7.90 for the delivery will be applied to orders above £70 (VAT & delivery fee exc) within a weight of 15kg. Any kg above the 15th is charged according to distance and other factors. If your order is above £70 (VAT & delivery fee exc), within a weight of 15kg and it has not to be delivered in a remote area, the delivery is free of charge for the next day 8:30-17:00 service.

3.4 Stock levels displayed are to be considered as a guide only. While every care is taken for the availability of a product to be correctly displayed, availability of stock can only be confirmed upon the preparation of the order.

3.5 You must be 18 years old or over and must have completed the registration process in order to participate in our service.

3.6 You must be 18 years old or above to order alcoholic drinks. By placing an order you confirm that you are at least 18 years old.

If you are buying a case of wine or spirit or liquor or beer as a gift the recipient must also be over 18 years old.

If our drivers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the alcoholic drink is unable to produce an appropriate ID, we regret our driver will be unable to leave the alcoholic drink.

Once the alcoholic drink has been delivered, according to your original delivery instructions, it becomes the recipient's responsibility.

4. AVAILABILITY OF THE WEBSITE

4.1 Although we aim to offer you the best service possible, no promise can be made that the services offered will meet your requirements. Maya UK Holding Ltd cannot guarantee that the service will be without fault, however the Company will remedy any issue as detailed in this T&C. If an issue occurs, you should report it to us within the timeline reported in these T&C in accordance with the Consumer Right Act and on Online purchases.

4.2 Access to the Website may be occasionally restricted to allow for repairs, updates, or maintenance. We will attempt to restore the service as soon as it reasonably can.

5. LIMITATION OF LIABILITY

5.1 To the full extent permitted by the applicable law, by purchasing on Nifeislife.com you agree that we will not be liable to you or any third party for any incidental or consequential damages, or any other indirect, special or punitive damages that arise out of or are related to the Website.

5.2 Any liability arising out of any order or supply of goods will be limited to the retail price of the goods contained in the particular order.

5.3 Nifeislife.com and its content is provided without warranties nor guarantees. You are the sole responsible for any risk incurred associated with the use of the Internet.

6. INTELLECTUAL PROPERTY

6.1 The information contained in the Website is protected by copyright, trade marks, and other intellectual property rights.

6.2 The Website contains information from third parties, such as the Brands represented, and while we try to ensure that any Product is of the highest quality, reputable, and correct, it cannot accept responsibility if this is not the case. The relevant sources of information are to be consulted and it is your responsibility to further research any information.

7. PRODUCT REPRESENTATION

7.1 All pictures shown are for illustrative purposes only. The packages and labels of the Products may vary.

7.2 We will not consider a product to be ‘not as described’ based on different interpretations of the products’ name and description.

7.3 Products sold on an ‘approximate weight’ basis will not be considered ‘not as described’ if the actual weight differs from the ‘approximate weight’.

7.4 When a specific brand is not mentioned in the name or description of the products, we reserve the right to send the available brand, ensuring it is of comparable quantity, size, quality, and price.

8. DELIVERY

8.1 Nifeislife.com delivers to the UK.

8.2 Deliveries are made either using our refrigerated vans or using a third party delivery Company. The areas and the different prices are marked in our delivery page. We reserve the right to restrict delivery in certain areas and this includes the right to eliminate any area from our delivery schedule altogether

8.3 Products labelled Selected London Areas Only will be delivered with our own refrigerated vans. Should you require these restricted items to be delivered by courier (if allowed), you need to contact us, and bear the full responsibility for any product damage and monetary loss.

8.4 Our deliveries are made on a shift basis. We reserve the rights to increase or decrease the availability of time slots available.

8.5 Yourself or an authorised person must be present to accept the delivery. However where the customer requests for us, or for us to instruct the courier, to leave the parcel in a specific location, we will comply. In these circumstances we will not accept claims of non-delivery, as the delivery will be considered completed either by our own drivers, or the courier Company.

8.6 If you, or a representative, is not present at the time of delivery, we will attempt to deliver a second time free of charge. If a redelivery is missed, then you will bear the cost of delivery as determined in point 10 of this T&C.

8.7 Should you fail to be present for the delivery and your order contains Made@Nifeislife (ready meal) items, Fresh Meats and Fish, or Bread, we are entitled to charge you for an amount equal to the total of the perishable items contained in your order.

9. AMENDMENT OF ORDERS AND CANCELLATION POLICY

9.1 You can add or remove items, change the address, add delivery instructions, or cancel your order by sending an email to us (info@nifeislife.com) stating the order number.

9.2 Any amendments or cancellation must be requested in accordance with our cut off times:

  • Orders within Selected London Areas: Monday to Friday by 8 am on the day of delivery for order with delivery time between 10.30 am and 4.30 pm, and by 12 pm for orders with delivery time between 4.30 pm and 10 pm. For cooked and fresh items, the cut off time is at 1.30 pm the day before the order is due to be delivered. Saturday by 8 am on the day of delivery for order with delivery time between 10.30 am and 6.30pm. On Saturday our last delivery is at 6.30 pm.

9.3 After delivery it is your statutory right to cancel the order (request a return) in full or in part within 14 days (8 days for perishable items) of the receipt of the goods. If the cancellation reason is outside of the terms defined in this T&C agreement, you will be responsible for the cost of the returning the goods to us and for any damage incurred to the goods before reaching our warehouse.

9.4 Fresh Fish, Fresh Meats, Fresh Bread, and items Made @ Nifeislife (ready meals) can only be cancelled by 1.30 pm two days before the delivery date. If you require to amend or cancel these items or a full order containing these items, it is your responsibility to bear the retail cost of the products.

9.5 If you cancel your order for any reason, even according to the cut off times, you may have to pay 3% of the total transaction

10. RETURNS/REFUND

10.1 You have the right to return or ask for a refund of any non-perishable items within 14 days of receipt of the order.

10.2 If you discover that there's something wrong with the product, such as a fault, damage or it's not as described as per the T&C defined in this agreement, you can request a refund by sending an email to info@nifeislife.com

10.3 At our discretion we will reserve the right to ask for an item to be returned to us at your expense or to collect the item ourselves. Please do not dispose of the product before contacting us. Return and refund requests are evaluated in accordance with these terms and conditions and in accordance with good faith and common sense. Shipping costs for returns for which there was an "order mistake" by the customer, a "change of mind" about the purchase or a return/refund request that cannot be accepted because it is contrary to these T&Cs (and / or good faith and common sense) are usually charged to the customer.

10.4 When you request a refund or a return of an item, we require a photo of the product as received and we reserve the right to deny the refund if it is found that we are not liable for the cost of the item as specified in this T&C agreement. Items must be returned intact and in original condition and packaging.

10.5 In the case of loss or damage of an order or a product, we will issue a refund or a voucher for a maximum amount of the damaged item and the delivery fee of that order.

10.6 If the delivery is delayed by more than 72hrs for reasons other than the ones in this T&C agreement we will issue a refund or a voucher for a maximum of the amount paid for the perishable items in the order.

10.7 If you, or a representative is not home to receive the delivery, we will reschedule to attempt the delivery a second time within the next day. You are responsible to bear the cost of any perishable items to be replaced should you miss the delivery a second time, or fail to provide an alternative delivery date within 24hrs of the missed delivery.

10.8 If the address selected is incorrect or incomplete, you need to notify us as soon as possible. If the order has already been shipped and there is a change in Delivery area, you are responsible for any additional delivery charges that may incur. or delays occurred In this event, we reserve the right to change the delivery date and/or time-slot.

10.9 If the product purchased on discount had an online label on the product page indicating its expiration date at the time of order, the product cannot be returned and/or refunded. If the customer purchases a product with an online label that indicates an expiration date, and selects a delivery date that is beyond the expiration date of the product, the product cannot be returned and/or refunded

11. PAYMENT

11.1 It is your responsibility to use a valid method of payment and pay the goods ordered in full an on time.

11.2 For orders within Selected London Areas, you can pay with card or cash. Orders Outside the Selected London areas, can only be paid with card payment.

11.3 Payment is processed at the moment of ordering, when you pay by card.

11.4 If you choose to pay by cash to the driver, it is your responsibility to have the total amount ready to give to the driver.

11.5 When you add items to your order, you are impliciting authorising us to proceed with the payment for a maximum of the sum of the retail price of the items added. If payment cannot be processed we will offer alternative payment methods. It is your responsibility to ensure the additional payment can be processed.

11.6 Payment information is handled by a third party Company and is not stored by us. The third party can be changed by us at any time. For more information regarding our current payment partner please visit the website https://stripe.com/en-gb

12. COMPLAINTS

12.1 Any complaints regarding the service offered on the Website will be assessed by our Customer Service. You can find the details on how to reach us on the ‘Contact Us’ page in the Website.

12.2 Complaints must be received within 14 days from the date of receipt of the order. We are not liable for any issues presented to us after this deadline.

13. PRIVACY

13.1 To order on Nifeislife.com we will require certain personal information necessary to process payment and to deliver the goods and services. We are committed to your privacy and we do not share, sell, or abuse your data.

13.2 The data necessary to efficiently process your order may include:

  • Your name

  • Name of the person receiving the order, if different from the person ordering

  • Billing address

  • Delivery Address

  • Payment information

  • Email Address

  • Your phone number

  • The number of the person receiving the order, if different from the person ordering

13.3 Unless you specifically authorise us, we will not use your email address for marketing purposes. You can subscribe and unsubscribe from our Newsletter through your account on the Website at any time.

13.4 As part of the shipping process it may be necessary to share some of your personal data with the courier company. These information is limited to:

  • Name of the person receiving the order, if different from the person ordering

  • Delivery Address

  • Email Address

  • The number of the person receiving the order, if different from the person ordering

13.5 Data is usually stored on systems indefinitely. It is your right to request of us any data we hold about you, to have any data removed permanently. To do so please send an email to our Customer Service info@nifeislife.com.

13.6 Nifeislife.com uses cookies in order to enhance the user experience, for example saving the items in your cart. You can delete the cookies from the privacy settings of your browser.

14. OFFERS AND PROMOTIONS

14.1 We have weekly and daily offers and promotions that are only valid for the date specified on the particular offer.

14.2 If there is a countdown to the offer, this is indicative of a prediction. The offer is only valid until stock lasts and will not be applied to orders thereafter.

14.3 Any offers and voucher details are subject to the terms and conditions of the single offer or voucher.

14.4 If an offer is not accepted, please read the terms and conditions of the offer carefully, and contact us immediately. We reserve the right to not apply for the offer when the T&C are not met and any issue is not reported within 24 hours.

14.5 Offers are subject to change without notice. To benefit from an offer we suggest placing an order as soon as possible.

14.6 Free delivery or Discounted delivery offers are subject to our delivery terms as per these T&C and as specified in our Delivery Page (see delivery page).
